Domestically, this practice has grown significantly in line with Singapore’s growing reputation as a centre for alternative dispute resolution, in particular for mediations and arbitrations. Internationally, we have been involved in arbitrations arising from many jurisdictions such as Brunei, India, Indonesia, Malaysia, PRC, Pakistan, Philippines, Thailand and Vietnam.

These arbitrations were either ad-hoc or conducted under the rules of various institutions such as the Singapore International Arbitration Centre, the Kuala Lumpur International Arbitration Centre, the International Chamber of Commerce and UNCITRAL.


Some of the landmark cases that we have been involved in are as follows:

 
  • The Practice Group has beaten its own record of having been involved in the largest and second largest adjudication claims under the Building and Construction Industry Security of Payment Act (commonly known as SOP Act).  It recently acted for and successfully defended a leading international developer against various claims in excess of SGD48 million by one of its main contractors in the largest adjudication application in Singapore under the SOP Act, which tops the second largest adjudication claim in excess of SGD17 million in which it was involved as well.

  • Represented a leading Nordic construction and property development company in Singapore in a dispute with its contractor relating to the MRT Circle Line Project.

  • Advised a leading charterer in Singapore in an arbitration under the LMAA (London Maritime Arbitrators Association) terms on a claim by the shipowner for loss of freight, demurrage, and expenses arising from alleged breaches of various charterparties.

  • Advised an oil major and international bank relating to the financing of international sales.

  • Advised project insurers in respect of the collapse of Nicoll Highway in Singapore.

  • Advised an Indonesian airline in respect of a lease of aircraft.

  • Advised an engineering company in respect of damage to aircraft whilst under service.

  • Advised international carriers in respect of an alleged misdelivery of cargo delivered in Morocco and of demurrage claims arising from detention of a vessel in East Africa.

  • Advised German contractors in respect of the installation of cargo handling facilities at Changi International Airport by their subcontractors.

  • Advised Australian contractors in respect of a dispute relating to the erection of a gas processing plant in Pakistan.

  • Advised Japanese contractors in relation to defects in a commercial building in Singapore.

  • Advised on various claims relating to the damage/ loss of cargo during marine or air carriage, injury to passengers during air carriage, or on sea cruises, on behalf of an airline in respect of foreign object damage to engines and commodity disputes.

  • Acted on behalf of a developer in respect of defects in a commercial building in Singapore.

Apart from acting as counsel, our lawyers also act as arbitrators, adjudicators or mediators and are on the panel of many institutions, such as the Singapore International Arbitration Centre, the Singapore Mediation Centre and the International Chamber of Commerce.

We have also advised on and represented parties in court applications relating to arbitrations, including the setting aside of awards and removal of arbitrator(s).
